I hate being right. I warned people years ago that something like this was headed to the Yakima Valley and was called a conspiracy nut. Well, how’s that conspiracy looking now? Folks, get the facts. The DOE already had the answer they wanted and the USGS study was designed to give them that answer. The so called”agreement” between the DOE, Bureau and Yakama Nation failed to follow the proper and legal protocol and had nothing to do with the lawsuit filed by the Yakama Nation, as purported by DOE for the last 13 years. The ban on new water rights was an”administrative moratorium” and had no rule adopted through the Administrative Procedures Act. What it all comes down to is the DOE figured out how to take an individual’s property right, without it being considered a Constitutional Takings … control the water, control the land, period.
